YAMADA BRAZIL builds strong and lasting relationships with its clients, franchise partners, users, and associates based on mutual trust. Therefore, ensuring that your Personal Data (as defined below) is secure and remains confidential is an absolute priority for YAMADA BRAZIL.

The terms of this Policy apply to Users and/or Visitors of the YAMADA BRAZIL website at https://www.yamadabrasil.com.br/ (hereinafter referred to as "sites"), which for the purposes of this policy shall be referred to as "DIGITAL CHANNELS."

Because YAMADA BRAZIL values and strives to protect the privacy and security of the Personal Data requested, it applies a very strict Policy to safeguard the protection of the Personal Data of those who use its sites. We recognize the importance of privacy, transparency, security, and data protection for our clients and for all data subjects whose Personal Data may be processed through YAMADA BRAZIL systems

PURPOSE OF THIS POLICY

YAMADA BRAZIL exerts its best efforts to provide adequate protection measures in all its operations and to implement the most consistent, effective, and rigorous policies and procedures. Recognizing the importance of your privacy, we have developed this Policy to inform you of the conditions under which we Process and Protect your Personal Data. This Policy also describes your rights and how you can contact us to exercise them or ask any questions you may have regarding the protection of your Personal Data.

By accepting the content of this Policy, you acknowledge that YAMADA BRAZIL is the Controller of your Personal Data, and you declare and agree that we may process your Personal Data in accordance with the terms set forth herein. You also acknowledge that this Policy may be modified at any time, with all updates published on this page. Therefore, we recommend that you read our entire Policy carefully. If you do not agree with these provisions, we ask that you immediately cease access and use of the sites.

DEFINITIONS

For the purposes of this Policy, the following definitions shall be considered, whether referred to in uppercase or lowercase, plural or singular, bolded or not, for your correct understanding

"Personal Data": Means any information related to an identified or identifiable natural person. This means that data is considered personal when it allows the direct or indirect identification of a natural person, such as: first name, last name, date of birth, telephone number, e-mail, etc.

"LGPD": General Data Protection Law (Lei Geral de Proteção de Dados Pessoais – Law No. 13,709, of August 14, 2018).

"Processing": Any operation performed with Personal Data, such as those relating to collection, production, receipt, classification, use, access, reproduction, transmission, distribution, processing, filing, storage, deletion, evaluation or control of information, modification, communication, transparency, dissemination, or extraction.

"Legal Basis for Processing": These are the legal hypotheses provided for in the LGPD that authorize YAMADA BRAZIL to process Personal Data.

"We, Us, or Our": Refers to YAMADA BRAZIL as defined herein

"You": Any natural person, in the capacity of a visitor and/or User of YAMADA BRAZIL Services, and/or the person responsible for a legal entity (Clients and/or Accredited Establishments) who accesses or interacts with the activities and/or Features available on the DIGITAL CHANNELS

"User": Employees and/or Users appointed by the companies contracting YAMADA BRAZIL's services to use the YAMADA BRAZIL services

"Controller": The natural or legal person, whether governed by public or private law, who is responsible for decisions regarding the Processing of Personal Data

IDENTITY AND CONTACT DETAILS OF THE CONTROLLER

YAMADA BRASIL FABRICACAO DE ARTEFATOS DE MATERIAL PLASTICO LTDA, herein after referred to as YAMADA BRAZIL, registered under CNPJ No. 16.502.282/0001-65, headquartered at Avenida Torquato Tapajós, 7891 – Tarumã – 69041-025 – Manaus/AM - Brazil, is the Controller of the Personal Data.

SOURCE OF PERSONAL DATA

YAMADA BRAZIL collects and processes your Personal Data so that you can register on our DIGITAL CHANNELS and use their features. Such Personal Data may be provided:

Personal data provided by the contracting company or by You

Personal Data is primarily collected through service requests sent by your employer and/or the company that referred your name to receive YAMADA BRAZIL services, or provided by you during your registration.

The information collected by YAMADA BRAZIL includes:

a) For natural persons: Name, Tax ID (CPF), e-mail, Telephone, Address, Marital Status, Education Level, Academic Background, Professional Experience, and Resume

Personal Data identified with an asterisk (*) in the data collection forms is mandatory to enable us to fulfill your requests and/or provide the requested services. If you do not provide this Personal Data, access to our services may be restricted or even unavailable.

Automatically Collected Personal Data: We collect certain information automatically when you visit our sites to personalize and improve your experience. We collect this information using various methods, such as:

Cookies

We may use "Cookies" to automatically collect information that allows us to identify features in which you may have the greatest interest, in order to improve the performance of our applications and provide you with a more personalized browsing experience

However, please be aware that if you disable "cookies" in your browser, you will not have a complete experience on Our sites. For example, you will not be able to benefit from automatic login and other personalization features.

Internet Protocol ("IP") Addresses

An IP address is a unique identifier used by some electronic devices to identify and communicate with each other on the Internet. When you consult our sites, we may use the IP address of the device you use to connect to the sites. We use this information to determine the general physical location of the device and to know the geographic areas where visitors are located. You can decide whether to enable or disable location tracking through your electronic device.

Statistics

The sites use Google Analytics, a web analysis service provided by Google, Inc. ("Google"), to generate statistical reports. These reports tell us, for example, how many users consulted the sites, which pages were visited, and the geographic areas of the users.

Site traffic information is only accessible to authorized personnel. We do not use any of this information to identify visitors and do not share it with third parties not directly or indirectly involved in the service provision

The sites use Google reCAPTCHA, a service to prevent software that crawls the Internet from creating artificial traffic or overloading a YAMADA BRAZIL service, making access more difficult for real users

PURPOSES FOR WHICH WE USE PERSONAL DATA

The Personal Data collected by YAMADA BRAZIL is used to provide our services, ensure they function as expected, improve them, and help enhance the reliability and security of all our services.

Specifically, YAMADA BRAZIL may use your Personal Data for the following purposes:

  • To administer, provide clarifications, and fulfill obligations arising from services contracted with YAMADA BRAZIL;
  • To provide information regarding services, features, and other relevant events related to user relations;
  • To register and manage operations carried out by users through the YAMADA BRAZIL portal;
  • To personalize and enhance your experience on our sites;
  • To collaborate with and/or comply with judicial orders or requests from administrative authorities;
  • Any other purpose that will be disclosed to you, if applicable, at the time your data is collected.

Please be aware that for anti-fraud monitoring and money laundering prevention purposes, YAMADA BRAZIL extracts and uses Personal Data from public sources and Personal Data provided by third parties (such as financial institutions), which may be associated with the Personal Data that YAMADA BRAZIL maintains about you.

YAMADA BRAZIL does not sell or trade information that can identify you.

LEGAL BASIS FOR PROCESSING PERSONAL DATA

YAMADA BRAZIL processes Personal Data in accordance with the Legal Bases established by the LGPD, in a manner that is adequate and compatible with the purpose of its collection. We process your Personal Data as part of the performance and management of our contractual relationship with you and/or with the company contracting our services; for our legitimate interests or those of third parties (provided that the legal requirements for doing so are met); in compliance with specific legal or regulatory obligations; or when necessary for the regular exercise of rights in judicial, administrative, or arbitration proceedings.

Your Personal Data may also be processed based on your prior consent, should your consent be requested under certain circumstances

SHARING OF PERSONAL DATA

The security and confidentiality of your Personal Data are of great importance to us. This is why we restrict access to your Personal Data solely to our duly authorized professionals who need to have knowledge of such data to process your requests or provide the services ordered

We will not disclose your Personal Data to unauthorized third parties. However, we may share your Personal Data with entities within the YAMADA BRAZIL group and with authorized service providers with whom we work (e.g., Call Center; relationship agents; BackOffice services; technology and information security consultants; etc.) whom we may engage for the purpose of providing our services. In these cases, we ensure that your Personal Data is processed only for legitimate, specific, and explicit purposes informed to you, without the possibility of subsequent processing in a manner incompatible with the stated purpose.

Should third-party companies perform the processing of any data collected through our sites, they must strictly respect the conditions stipulated herein and comply with the applicable current legislation

We do not authorize our service providers to use and/or disclose your Personal Data, except to the extent necessary to provide services on our behalf or to comply with legal obligations. Our service providers will only use your Personal Data in accordance with instructions issued by YAMADA BRAZIL and in compliance with the purposes mentioned in this Policy.

Furthermore, we may share Personal Data about you when we believe, in good faith, that we have an obligation to:

  • Comply with a law, regulation, or court order;
  • Respond to requests for information made by a regulatory body, police authority, or other public authorities, including cases related to national security;
  • Enforce and/or protect the property or rights of YAMADA BRAZIL, including investigating fraud and helping to prevent security threats, including information security, or other criminal or malicious activities; or
  • Protect the legitimate interests of third parties, including the personal safety of YAMADA BRAZIL employees YAMADA BRASIL.

RECORDING OF ACTIVITIES

To carry out its activities, YAMADA BRAZIL may record, where applicable, the access performed by users on our sites, including

  • IP Address and Source Logical Port of the users;
  • Actions performed by users on the sites;
  • Screens accessed by users;
  • History of operations performed
  • Identified behaviors during interaction with the sites

The purpose of this process is to collect and analyze access logs for internal controls, audit support, and traceability. Other technologies may be used to obtain user browsing data, always respecting the conditions of this Policy

STORAGE OF YOUR PERSONAL DATA

We store your Personal Data in our databases, in a secure environment, ensuring its privacy and confidentiality, only for the time necessary to fulfill the purposes for which it was collected, observing any legal periods and the need for YAMADA BRAZIL’s defense in legal proceedings. However, we may occasionally need to retain your Personal Data for a longer period due to applicable laws or regulations. Once the period and legal necessity have ended, your Personal Data will be deleted using secure disposal methods or used in an anonymized form for statistical purposes.

The Personal Data obtained may be stored on YAMADA BRAZIL's own servers or those of a third party contracted for this purpose, whether allocated in Brazil or abroad. Furthermore, they may be stored through cloud computing technology and/or others that may arise in the future, always aiming for the improvement and enhancement of our activities, while respecting security levels and market best practices.

SENSITIVE PERSONAL DATA

"Sensitive Personal Data" means any information relating to racial or ethnic origin, religious conviction, political opinion, union membership, or membership in a religious, philosophical, or political organization, health data, or data relating to sexual orientation, genetic or biometric data, when linked to a natural person.

As a general rule, we do not collect Sensitive Personal Data through our sites.

Should it be strictly necessary to collect such data to achieve the purpose for which the processing is carried out, we will do so in accordance with local legal requirements for the protection of Personal Data and, in particular, with your prior specific and highlighted consent, for specific purposes under the conditions described in this Policy.

PROCESSING OF PERSONAL DATA OF CHILDREN AND ADOLESCENTS

YAMADA BRAZIL does not intentionally collect Personal Data from children and adolescents through its sites. To use the sites, the user must be at least 14 (fourteen) years old and, if under 18 (eighteen) years old, must be assisted by their parents or legal guardians, as provided in the Terms of Use. Parents or legal guardians shall be held responsible for any and all acts performed by minors while using the sites.

INTERNATIONAL TRANSFER OF PERSONAL DATA

Occasionally, your Personal Data may be transferred to recipients located outside of Brazil and authorized to perform services on our behalf. Data protection laws vary by country; however, in the event of an international transfer to recipients located in other countries, we will adopt the necessary measures to ensure the existence of adequate safeguards for the protection of your Personal Data in accordance with the LGPD and in compliance with the protections described in this Policy.

Although there are express legal provisions authorizing International Transfer beyond those indicated herein, YAMADA BRAZIL is most likely to transfer your Personal Data abroad in one of the following scenarios:

  • When performed to countries or international organizations that provide a degree of Personal Data protection adequate to that provided for in the LGPD;
  • When the data subject has provided specific and highlighted consent for the transfer; or
  • When there are contractual clauses submitted for approval by the National Data Protection Authority (ANPD)

EXERCISING YOUR RIGHTS UNDER THE LGPD

YAMADA BRAZIL respects the rights you hold as a Personal Data subject, and we enable their exercise in accordance with applicable legislation. Below is a table summarizing your various rights:

Right to confirmation and access

You have the right to confirm whether we process Personal Data relating to you and to access the Personal Data you provided and/or that we maintain about you

Right to correction

You may request the correction of incomplete, inaccurate, or out-of-date Personal Data if provided directly by you. If provided by the contracting party (your employer/referring company), the correction request must be made directly to them

Right to anonymization, blocking, or deletion

You may request the anonymization, blocking, or deletion of unnecessary or excessive data, or data processed in non-compliance with the LGPD.

Right to information on data sharing:

You may request information regarding public and private entities with which we have shared your Personal Data. This information is detailed in item 8 of this Policy.

Right to refuse consent and consequences

You may request information about the possibility of not providing consent and the potential consequences of such refusal.

Right to revoke consent:

You may request the revocation of your consent at any time via express statement. All processing performed under prior consent remains ratified. Revocation can be done directly on our sites and apps

Right to data portability:

You may request a review of decisions taken solely on the basis of automated processing that affect your interests, including profiling (personal, professional, consumer, or credit).

Right to object

You may object to processing based on one of the legal hypotheses that waive consent in case of non-compliance with the LGPD. This exercise depends on the necessity of the data for service execution and joint evaluation with the contracting company.

Right to review automated decisions

You may request a review of decisions taken solely on the basis of automated processing that affect your interests, including profiling (personal, professional, consumer, or credit).

Right to deletion of data processed with consent

You may request the deletion of data processed based on your consent, except in the following cases allowed by the LGPD:

  • Compliance with a legal or regulatory obligation by the Controller
  • Study by a research body ensuring anonymization whenever possible
  • Transfer to a third party, provided the LGPD processing requirements are met
  • Exclusive use by the controller, prohibited from third-party access, provided the data is anonymized

To ensure your privacy and as a security and fraud prevention measure, we may request proof of identity before processing your request

We implement the best market practices for technical and administrative security possible to protect your Personal Data from unauthorized access and from accidental or unlawful situations involving destruction, loss, alteration, communication, or dissemination, as determined by current legislation.

However, please be aware that no company, including YAMADA BRAZIL, can totally eliminate the security risks associated with the Processing of Personal Data. For your safety, it is essential that you protect yourself from unauthorized access to your password and your computer, as your access is for personal and non-transferable use, being your sole and exclusive responsibility. In the event of an attempted improper or unauthorized access, you must notify YAMADA BRAZIL as soon as possible.

ACCESS AND UPDATES TO OUR PRIVACY POLICY

By accessing and using YAMADA BRAZIL sites, you expressly agree to this Policy. Acceptance of this Privacy Policy is absolutely essential for the use of the sites

You must read, ensure you have understood, and accept all conditions established in this Policy, as well as in other documents incorporated herein by reference, before registering as a user of the sites and the App.

By accepting the terms of this Policy, you expressly agree to provide only true, current, and accurate Personal Data. You shall be solely responsible for any false, outdated, or inaccurate information you provide directly to YAMADA BRAZIL.

As we are always seeking to improve our Services, YAMADA BRAZIL reserves the right to change, supplement, or update this Policy at any time and without prior notice, particularly to comply with any legal, regulatory, case law, or technical developments that may arise. However, your Personal Data will always be processed in accordance with the policy in effect at the time of data collection, unless a mandatory legal provision determines otherwise and must be applied retroactively.

Should any change occur in this Policy, we will publish the new version on the sites, indicating the revision date so that you may always be aware of the updated content

All modifications shall take effect immediately upon publication of the revised Privacy Policy, unless otherwise specified. Therefore, we recommend that you periodically consult this Policy to remain informed of any changes

By using the YAMADA BRAZIL sites after such changes, you are re-consenting to the terms of the revised Privacy Policy

If you do not agree with the changes made and the new terms of our Policy, immediately cease using the sites. Continued use of our sites after changes to this Policy will indicate that you accept and agree to the changes made.

The date of the last update of this Policy is indicated at the beginning and reflects its effective date. Previous versions of this Policy may be requested via the email address indicated herein.

APPLICABLE LAW AND JURISDICTION

This Privacy Policy shall be governed, interpreted, and executed in accordance with Brazilian legislation, in the Portuguese language. The Courts of the District of Manaus - AM are hereby elected to resolve any litigation or controversy involving this document, except for specific reservations regarding personal, territorial, or functional competence under applicable law. Outside the State, JUSPRO – Justiça Sem Processo Mediação e Conciliação S/S Ltda. is designated as the Mediation Chamber capable of resolving issues involving Data Subjects, pursuant to Article 52, §7 of the General Data Protection Law (LGPD).

They will lead the new practices adopted by the company, which have been implemented since June 2025, always aiming to maintain the DATA SECURITY standards adopted by the company.
